Although military couples who divorce in Colorado are subject to state law, a host of special considerations arise by virtue of one spouse serving in the Armed Forces. Working with an experienced Palmer Lake military divorce lawyer from Travis Law Group can make your divorce process easier. We are well-versed in determining what military issues are relevant to each individual case.

Military-specific laws can impact your divorce. We can help.

For instance, we are experienced in laws, such as Servicemembers Civil Relief Act and Uniformed Services Former Spouses’ Protection Act (USFSPA), which often apply to service members and military families.

Moreover, the military lifestyle and demands placed on service members and their families may have legal implications. For example, the need to make PCS moves may bring up jurisdictional issues. Military members are also subject to deployment with little, if any, notice. Therefore, parenting plans should take into account this constraint.

As another consideration, one of the most important benefits of military service is the retirement entitlement. Military retirement pay is marital property and, as such, is subject to division. Division of military retired pay is complex and requires evaluation of the various compensation plans and qualified deductions for which the service member may be eligible, along with the applicable legislation and case law.

In order to divide military retirement pay, Colorado courts have devised a specific formula. This formula, called the Hunt formula (or sometimes referred to as the Hunt/Gallo formula or the coverture formula) takes into consideration the length of a spouse’s military service and the years of marriage that overlapped with the years of military service. If there is perfect overlap between the two, the other spouse is entitled to half of the military retired pay minus any qualified deductions.
